1. Legal guarantee

The products sold to consumers benefit from the legal guarantee of conformity regulated mainly by GEO no. 140/2021. The seller is liable to the consumer for the non-conformity that exists at the time of delivery and is found withintwo years from delivery, under the terms of the law. Legal rights exist independently of any commercial warranties.
2. What compliance means
The product must, where applicable, correspond to the agreed description, type, quantity and quality; be appropriate for the normal purpose and the accepted special purpose; be supplied with the accessories and instructions provided; and have the characteristics of durability, functionality and security that the consumer can reasonably expect, taking into account the nature of the product and the relevant public statements.
3. Presumption regarding the moment of non-compliance
A non-conformity found within one year of delivery is presumed, until proven otherwise and with the exceptions provided by law, as already existing at the time of delivery when this presumption is compatible with the nature of the product and the non-conformity.
4. Repair or Replacement
To bring the good into conformity, the consumer can choose between repair and replacement, unless the chosen measure is impossible or, compared to the available alternative, would impose costs disproportionate to the concrete circumstances.
The repair or replacement is carried out at no cost and within a reasonable period which, under the conditions of GEO no. 140/2021, cannot exceed 15 calendar days from informing the seller, the term being established by mutual agreement, in writing, taking into account the nature of the good and the non-conformity.
5. Non-compliance found in the first 30 days
Consumers benefit from the replacement of goods when the non-conformity is found shortly after delivery, without exceeding 30 calendar days, under the conditions of GEO no. 140/2021, as approved and amended.
6. Price reduction or termination of contract
In the cases provided by law, including when compliance is not achieved, is refused, the non-compliance persists or is sufficiently serious, the consumer may have the right to a proportional price reduction or termination of the contract. Termination of the contract is not available for minor non-compliance, under the law.
7. How to report non-compliance
Send to contact@lacesecret.rothe order number, the product concerned, a description of the situation and, if it helps to identify the problem, photos. You don't need to use legalese. We will communicate the verification and remedial steps and, if necessary, how to make the product available to the seller.
8. What does not affect legal rights
A commercial return policy, a promotion or any commercial guarantee cannot remove or reduce the consumer's mandatory rights regarding non-conformity. Also, the withdrawal exceptions for hygiene-sealed products do not remove the consumer's rights if the product is non-conforming.
The main framework considered: GEO no. 34/2014 regarding consumer rights, Law no. 365/2002 on electronic commerce, GEO no. 140/2021 regarding contracts for the sale of goods, Regulation (EU) 2016/679 (GDPR), Law no. 190/2018 and Law no. 506/2004. In case of inconsistency, the mandatory legal norms in force prevail.
